PERSONAL INFORMATION COLLECTION STATEMENT
China Pacific Life Insurance (H.K.) Company Limited (the “CPIC Life (HK) ”, “we”, “us” or “our”) respects and protects your privacy and pledges to comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the laws of Hong Kong Special Administrative Region ("Hong Kong")) (the "Ordinance"). This statement applies to our recruitment and selection process and human resources management and sets out why the Company collects the personal data, how it is intended to be used, to whom it may be provided to and how to access, review and correct the personal data. Any reference to “personal” in this statement is a reference to something of an individual who is a data subject as defined under the Ordinance, including but is not limited to job applicants, existing employees, resigned employees and the data subjects from whom we need to collect personal data for the following purposes from time to time.
1.Personal data collected and / or held by CPIC Life (HK)
In this statement, “personal data” bears the same meaning as defined under the Ordinance. It includes any data (a) relating directly or indirectly to a living individual; (b) from which it is practicable for the identity of the individual to be directly or indirectly ascertained; and (c) in a form in which access to or processing of the data is practicable.
Depending on the situation,the personal data that the Company collects and/or holds may include but is not limited to name, identity card number, contact information, bank account number, education details, work experience and relevant employment information and past salary information and proof.
CPIC Life (HK) will keep the personal data for as long as necessary to achieve the purpose for which it was collected and to comply with prevailing legal requirements. If CPIC Life (HK) no longer needs the personal data for any purposes, the Company will take reasonable steps to securely delete or destroy personal data.
2.Consequence of failing to provide personal data
Job Application
If you do not provide us part or all of the requested personal data, it may inhibit CPIC Life (HK) from processing your application. Thus, the provision of the personal data for the purpose of job application is obligatory.
Employment Relationship Management
If you do not provide us part or all of the requested personal data, it may inhibit CPIC Life (HK) from continuing establishment of or maintaining an employment relationship, or handling matters in respect of the employment relationship. Thus, the provision of the personal data for the purpose of employment relationship management is obligatory.
3.Purposes of personal data collected by CPIC Life (HK)
Depending on the situations, personal data may be collected and used for the following purposes:
- a) assessing the job applicant’s suitability to assume the job duties of the position for which the job applicant has applied;
- b) determining preliminary remuneration, bonus payment, and benefit package to be discussed with the job applicant;
- c) negotiating with and making offers of employment to selected job applicant;
- d) adjustment and provision of benefits, compensation and payroll for current/former employees;
- e) setting up and managing staff record, payroll and enrolment of benefit schemes;
- f) supervision and management of CPIC Life (HK) and employees work arrangement;
- g) maintaining, reviewing and developing the overall human resources arrangements of CPIC Life (HK), its parent company China Pacific Life Insurance Co., Ltd. ("CPIC Life") and its group company China Pacific Insurance (Group) Co., Ltd. (“CPIC Group”) (together with "CPIC Life", hereinafter collectively referred to as "CPIC Group Company");
- h) supporting job performance assessment, promotion arrangement, appointment approval and career development related activity;
- i) review of employment decisions;
- j) contacting employees when absent from the office;
- k) assessing the training and development needs of employees;
- l) allowing CPIC Life (HK) to fulfil contractual or statutory obligations
- m) administering retirement and/or provident fund schemes to which employees contribute and/or from which they may benefit;
- n) any residual employment-related activities in relation to the former employees including (but not limited to) provision of job references; processing applications for re-employment and matters relating to retirement and/or provident fund scheme payments; and allowing CPIC Life (HK) to fulfil contractual or statutory obligations;
- o) confirming the identity of and distinguishing the individual identity of the job applicant and/or employee (as the case may be);
- p) confirming the accuracy of the information collected from the job applicant and/or employee (as the case may be);
- q) any purposes in connection with any claims made by or against or otherwise involving employee in respect of his or her employment including but not limited to making, defending, analysing, investigating, processing, assessing, determining or responding to such claims;
- r) performing any functions and activities related to recruitments including (but not limited to) data research and analysis;
- s) conducting matching procedures, including statistic and research, classification and analysis of job applicant and / or employee, maintenance of his/her files, data comparison for any of purposes set out in this section, and establishment of database to defect fraud (“matching procedure” is defined in the Ordinance. It broadly includes comparison of two or more sets of the data subject's data for purposes of taking actions adverse to the interests of the data subject);
- t) exercising any rights CPIC Life (HK) may have in connection with the employment of employees;
- u) conducting identity, bankruptcy, civil litigation and/or credit checks;
- v) determining any amount of indebtedness owing to or by employees, and collecting and recovering any amount receivable from the employee or any person who has provided any security or undertaking for the employees’ liabilities;
- w) purposes specifically provided for in any particular job assignments to employees;
- x) any other purposes in accordance with the general policies of CPIC Life (HK) in relation to human resource management as set out in notices, circulars, or other terms and conditions made available to employees by CPIC Life (HK) from time to time;
- y) human resources statistics and analysis conducted by CPIC Life (HK) and CPIC Group Company;
- z) other purposes directly relating to any of the purposes above.
4.Transferees
The personal data collected by CPIC Life (HK) will be kept confidential but may be transferred and disclosed to any of the following parties, whether within or outside Hong Kong, for the purposes as specified in a) to z) above:
- a) CPIC Group Company;
- b) insurance intermediaries, insurance companies, bank, financial institution partners and medical service providers;
- c) mandatory provident fund administrator or account manager;
- d) joint promotion / co-branding / banking and/or financial institution partners;
- e) any third-party administrators, claims investigation firms, notaries, medical bill review firms, risk intelligence providers and professional consultants;
- f) any third-party service provider who provides administration, telecommunications, computer, payment, printing, redemption and rewards, research survey, debt collection, credit information, data processing, information technology and storage, mailing, system security, medical services, emergency support services, customer service, premium collection and other services for achieving any of the human resources management related purposes as specified in a) to z) above.
- g) any company or third party who represents us to fulfil contractual or statutory obligations owed to the data subjects;
- h) any applicable and relevant associations and federations of the insurance industry;
- i) any (whether within or outside Hong Kong) regulators, governmental bodies, tax authorities, law enforcement agencies, courts and judicial bodies; and
- j) any other parties as notified to data subjects at the time of collection.
5.Security Policy
To ensure proper use and accuracy of the personal data collected and to prevent unauthorized or accidental access, processing, deletion or other uses of the personal data collected, we have implemented various physical and electronic measures to protect the personal data collected.
Under normal circumstances, personal data provided by job applicants for unsuccessful job application will not be retained for more than six months, unless there is sufficient justification that we must retain personal data for a longer period of time. Such personal data and materials will be treated confidentially unless a job applicant has accepted an offer of employment with the Company, in which case such personal data will be transferred to the job applicant's employee personal file.
It is our policy to retain employee’s personal data for a period of seven years after the employment has been terminated. The terminated employee’s personal data is required to handle termination matters, including but not limited to providing performance reviews, processing terminated employee's re-employment application and handling retirement benefit related matters, and facilitating CPIC Life (HK) in performing its contractual or statutory obligations.
6.Access, Correction and Enquiries
Pursuant to the provision of the Ordinance, you have rights to request access and/or correct your personal data that is kept by us. To exercise the rights above, please make a written request to our Data Protection Officer (Human Resources & Administration Department) and mail to China Pacific Life Insurance (H.K.) Company Limited. at Room 1802, 18/F, Lee Garden One,33 Hysan Avenue, Causeway Bay, Hong Kong.
